Terms and conditions of use

Preamble

The Chatbot described herein, based on the ChatGPT technology developed by Open AI, was designed by EDSI-Tech Sàrl, which can be contacted at the following address: contact@edsi-tech.com.

These General Terms and Conditions of Use (GTCU) govern the use of the Chatbot by the Customer and the User. These GCU may be amended from time to time. The Customer will be informed of any changes as soon as possible.

By using and making available the Chatbot on its platform, the Customer and the User are deemed to have read and accepted these GCU.

Definitions

  • Chatbot: service tool developed on the basis of ChatGPT technology by the Publisher and made available on the Client’s platform.
  • Client: natural or legal person who will make the Chatbot available to Users.
  • Publisher: the company EDSI Tech Sàrl based in Lausanne.
  • Services: information and other services provided by the Chatbot.
  • User: natural person who uses the Chatbot.

Use of the Chatbot

Our Chatbot is based on artificial intelligence from OpenAI. It has been trained on tourism data specific to the region.

The Chatbot is constantly learning in order to improve its Services.

The Services and advice provided by the Chatbot are for information purposes only and in no way replace professional advice. It is strongly recommended that you check the information given directly with the service providers concerned, particularly with regard to opening times, availability, access conditions, prices or the possibility of accommodation in the area.

Any use of the Chatbot that contravenes current legal provisions is prohibited.

In particular, it is forbidden to attempt to interfere with the Chatbot or the Services in any way that would harm, damage or overload the Chatbot.

The User undertakes not to cause any prejudice to the Chatbot Editor through the use of the Services, or in any other way whatsoever.

Third-party content

Content from third parties or third-party sites is provided for information purposes only. The use of third party services or sites is subject to the third party’s terms of use.

Under no circumstances will the Chatbot Editor be held responsible for content displayed and originating from third parties, or for hypertext links leading to third-party content.

The Chatbot Editor shall not be held liable for any third-party content displayed and provided to the User.

Liability

The Services provided by the Chatbot are for information purposes only. The information provided should not be considered as professional advice. Neither the Publisher nor the Customer accepts any liability in connection with the Chatbot, in particular for the content of the Services provided by the Chatbot, or for any action taken on the basis of the information provided.

In particular, no guarantee shall be given as to the accuracy or content or completeness of the information displayed, or as to its truthfulness or up-to-dateness.

The Chatbot and its Services are in principle available and at the disposal of the Customer and Users. However, the Publisher does not guarantee any availability of the Chatbot or the Services. The Publisher shall not be held liable for any interruption of access, overload of the Chatbot or the network, closure of the Chatbot or any damage whatsoever resulting therefrom.

In particular, any interruption of access or suspension of the Services provided may occur due to technical problems or maintenance and will not give rise to any compensation on the part of the Publisher.

The Publisher shall not be held liable in any way in the event of force majeure.

Intellectual property

The Chatbot and the databases it contains are the exclusive property of the Publisher.

Any use, reproduction, copying or making available of the Chatbot or the Services by a third party is strictly prohibited without the Publisher’s authorisation.

Legal information

Exchanges with the Chatbot may be collected in order to improve its operation and to provide the Services.

By using the Chatbot, Users consent to the collection and processing of the data they transmit. In addition to this data, the Chatbot may process the following technical data:

  • IP address ;
  • Date and time of the request ;
  • Time zone differences with GMT ;
  • Request content ;
  • Access status / http status code ;
  • Volume of data transmitted;
  • Internet platform from which the request originated.

Unless otherwise agreed by the Publisher, the User and the Customer are bound by the terms of these TOU.

In the event of any provision of these TOU being held to be void, unenforceable or invalid, the Publisher, the Customer and the User hereby declare the remainder of these TOU to be in full force and effect.

Ineffective or invalid clauses will be replaced by one or more legally valid provisions whose content is as close as possible to these clauses. The ineffectiveness and/or incompleteness of any provision shall not affect the validity of the remaining provisions.

The Publisher reserves the right to modify unilaterally and without prior notice the third-party content provided by the Chatbot, as well as access to the Chatbot by a User.

Applicable law and place of jurisdiction

These GTC are governed exclusively by Swiss law.

Any dispute arising in connection with these TOU shall be submitted to the exclusive jurisdiction of the Publisher’s registered office.
